These Terms of Use (“Terms”) apply to your use of Monitoris’ software, websites, applications and services (“Services”). By using our Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Who We Are

2. Use of Our Services

You may use our Services only if you are legally competent to enter into a binding agreement. If you are under 18, you must have your parent’s or guardian’s permission.

  • Not misuse or interfere with the Services.
  • Not reverse engineer, copy or resell the Services or any part of them.

You are responsible for keeping your login credentials confidential and for all activity under your account.

3. AI-Based Functionality

Monitoris uses third-party AI services such as OpenAI’s ChatGPT and Google’s Gemini to support various features. Your inputs may be processed by these tools to generate output. Monitoris may use your content to improve the Services, for example by analysing usage patterns or addressing recurring issues. However, we do not allow third-party providers like OpenAI or Google to use your data to train their own models. Providers like OpenAI and Google only use content as described in their respective terms.

Generated content may not be accurate. You are responsible for evaluating its appropriateness and accuracy before relying on it.

4. Content Responsibility

You are responsible for the content you upload, create, or share using the Services. You must ensure that your content complies with applicable laws and does not infringe on the rights of others.

5. Beta Phase Disclaimer

Monitoris is currently in beta. This means:

  • Features may change or be discontinued without notice.
  • We recommend not entering any sensitive or business-critical information during this phase.
  • There may be bugs or interruptions.

6. Intellectual Property

All rights to the Services, including software, content, and design, remain with Monitoris AG or its licensors. You may not use our name or branding without prior written permission.

7. Termination

We may suspend or terminate your access to the Services if you violate these Terms, abuse the Services, or act unlawfully. You may stop using the Services at any time.

8. Liability

Monitoris provides the Services “as is” without any guarantees. To the extent permitted by law, Monitoris is not liable for:

  • Indirect or consequential damages,
  • Loss of data or profits,
  • Malfunctions due to beta-stage development,
  • Content generated by AI tools.

9. Governing Law and Disputes

These Terms are governed by Swiss law. Any disputes shall be handled by the courts in Zürich, Switzerland.

10. Changes to These Terms

We may change these Terms from time to time. Significant changes will be announced via the app or website.
